What rights apply when students film me, or I want to film them?

Answer

If recording a lecture or student performance, a number of issues need to be considered:

  • will you be using video or audio clips? if so, is it permissible to show them outside the University? (see guidance on the filming of materials during the course of a lecture)
  • where will the recording be shown?
  • performance rights - do you have the permission of all participants/performers? 
  • data protection issues - the recording of living individuals, for example during lecture capture, constitutes the processing of their personal data

Further copyright clearance is likely to be needed if you are recording an event in which third-party materials are used.

Check what licences apply to any materials being used and whether the terms include making them available via a recording.

If neither the exception to the copyright law nor the terms of the licence cover the recording, you will need to obtain permission from the rights holder(s).
