Do I have to get permission every time I record a lecture?
Answer
You need to obtain consent from all ‘performers’ including lecturers/tutors as well as students and/or third parties to record and disseminate a lecture, in order to avoid any infringement of the performer’s rights.
You also need to consider Data Protection law; where a person’s inclusion in the recording reveals significant biographical information (e.g. where their faces are identifiable) about them you will need consent to record. A general audience shot is unlikely to do so, but it might be wise to give students/other audience members the option of sitting in an out-of-camera shot location.
Where consent is sought, limiting the availability of the recording (e.g. within a password-protected VLE module) is likely to help persuade participants to agree.
Consent forms should include:
- a description of the purpose for which the recordings may be used (e.g. revision)
- where the presentations will take place (e.g. at the Unversity)
- when the presentations will take place (e.g. during a specific period)
- to whom they will be made available (e.g. on the VLE or Internet)
